These Terms and Conditions set out the basis on which Rubbish Removal Waterloo provides rubbish clearance, waste collection and related services to residential and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation placing a booking with Rubbish Removal Waterloo.

Company, we, us or our means Rubbish Removal Waterloo, the provider of the rubbish removal and waste collection services.

Services means any rubbish removal, waste collection, bulky waste clearance, garden waste removal, office clearance, house clearance, or associated services that the Company agrees to provide to the Customer.

Site or Premises means the address or location at which the Services are to be carried out.

Waste means the items, materials or rubbish that the Customer asks the Company to remove, subject to any exclusions or restrictions set out in these Terms and Conditions and applicable waste regulations.

Scope of Services

The Company provides rubbish removal and waste collection services, including but not limited to household waste, office waste, garden waste and general non-hazardous refuse. The exact scope of the Services will be agreed with the Customer at the time of booking or upon arrival at the Site, based on the volume, type and accessibility of the Waste.

The Company reserves the right to refuse to collect certain items, including but not limited to hazardous or prohibited materials, where removal would breach waste regulations, health and safety rules, or is deemed unsafe or impractical by our operatives.

Booking Process

Bookings for rubbish removal or waste collection can be made by telephone or other communication methods accepted by the Company. The Customer is responsible for providing accurate information at the time of booking, including the type and approximate volume of Waste, the condition of the Site, access arrangements, parking restrictions and any other relevant information.

Any quotation or estimate given before the collection is based on the information supplied by the Customer. If on arrival the Waste is significantly different in volume, type or access difficulty from that described at the time of booking, the Company may adjust the price accordingly, subject to the Customer’s agreement. If the Customer does not accept the revised price, the Company may cancel the Service for that visit, and a call-out or cancellation fee may apply.

Bookings are subject to availability. The Company will use reasonable efforts to attend at the agreed date and time window but does not guarantee that operatives will attend at an exact time. Time is not of the essence in relation to attendance, and delays may occur due to traffic, weather, operational issues or other circumstances beyond our reasonable control.

Access and Parking

The Customer is responsible for ensuring suitable access to the Site for our vehicles and operatives. This includes arranging any necessary parking permits or authorisations, and ensuring that entrances, driveways, stairways and internal areas are reasonably clear and safe for the removal of Waste.

If adequate access or parking is not available on arrival and this prevents or materially hinders the performance of the Services, the Company may charge waiting time, an additional access fee, or may cancel the booking and charge a call-out or cancellation fee.

Customer Responsibilities

The Customer must ensure that:

The Waste to be collected is clearly identified and ready for removal, unless a loading and sorting service has been agreed as part of the booking.

No hazardous or prohibited materials are presented for collection, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, pressurised containers, gas bottles, explosives or any other item identified as hazardous under relevant waste regulations.

Any fragile, high-value or personal items are removed from the area where the rubbish removal will take place, to avoid accidental damage or disposal.

Where required, the Customer is present at the Site during the collection to confirm what is to be taken and to authorise any changes to the scope or price of the Services.

Prohibited and Restricted Waste

The Company operates in accordance with applicable UK waste regulations. Certain types of Waste cannot be collected or require special arrangements. The Customer must not present any Waste that is legally prohibited from collection, transport or disposal without the appropriate licences or consents.

If hazardous or prohibited materials are identified at the Site, the Company may refuse to handle them and may withdraw from the job. If such materials have been mixed with other Waste, the Company may treat all such Waste as contaminated and refuse collection or charge additional fees for safe handling, where lawful and practicable.

Quotations and Pricing

Prices are generally based on the volume, type and weight of the Waste, as well as the labour required and any additional access or disposal costs. Any quotation given prior to the visit is an estimate only and is not binding until the Waste has been assessed by our operatives on arrival.

Once the Waste has been inspected, the operative will confirm the final price before loading the Waste. If the Customer agrees to the price, the Company will proceed with the Services. If the Customer does not agree, the Company may cancel the collection and a call-out or minimum charge may apply.

The Company may apply additional charges for heavy loads, difficult access, additional labour, out-of-hours services, waiting time caused by the Customer, or any other factor that materially increases the time or cost of providing the Services.

Payments

Unless otherwise agreed in writing, payment is due in full on completion of the Services on the day of collection. The Company accepts payment by methods advised at the time of booking or by the operative.

For business or repeat Customers, the Company may, at its discretion, agree to provide credit terms. Where credit terms are agreed, payment must be made in accordance with the specified due date on the invoice. The Company reserves the right to charge interest and late payment fees on overdue amounts in line with applicable law.

The Customer is responsible for ensuring that all payment details provided are correct and that sufficient funds are available. If payment is not made when due, the Company may suspend further Services and may take steps to recover any outstanding sums, including legal action where necessary.

Cancellations and Amendments

The Customer may cancel or amend a booking by contacting the Company using the agreed communication channels. Where possible, the Customer should provide at least 24 hours notice before the scheduled collection time for standard bookings.

Where adequate notice is provided, the Company will cancel or reschedule the booking without additional charge. If notice is not provided within the required timeframe, or if our operatives attend the Site and are unable to perform the Services due to circumstances within the Customer’s control, the Company may charge a cancellation or call-out fee to cover its costs.

The Company reserves the right to cancel or reschedule a booking due to events outside its reasonable control, including but not limited to vehicle breakdown, severe weather, staff illness, accidents, legal restrictions or safety concerns. In such circumstances, the Company will attempt to notify the Customer as soon as practicable and will offer a new appointment time. The Company will not be liable for any loss arising from such cancellation or rescheduling, other than refunding any pre-paid amount for Services not provided.

Performance of Services

The Company will exercise reasonable care and skill in providing the rubbish removal and waste collection Services. Operatives will load the Waste onto our vehicles and transport it to a licensed facility for treatment, recycling or disposal in accordance with applicable waste regulations.

The Company does not guarantee that any particular proportion of Waste will be recycled, but will use reasonable efforts to maximise recycling and recovery in line with the facilities available and the type of Waste collected.

Damage and Liability

The Company will take reasonable care when carrying out the Services at the Site. However, the Customer accepts that some minor damage or marking may be unavoidable when removing large, bulky or awkward items, especially where access is restricted. The Customer should take reasonable steps to protect floors, walls and other surfaces if they are concerned about potential damage.

The Company shall not be liable for:

Any pre-existing damage to the property, fixtures, fittings, items or surfaces at the Site.

Any damage caused as a result of poor construction, defective materials, hidden defects or weakness in the property or items being moved.

Any loss or damage arising from the removal of items that the Customer failed to identify as fragile, high value or of special significance.

Any indirect, consequential or economic loss, including loss of profit, loss of business, loss of data, or loss of opportunity, whether arising in contract, tort or otherwise.

The Company’s total liability for any loss or damage arising from the provision of the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by the Customer for the specific Service during which the event giving rise to the claim occurred, except where such limitation is not permitted by law.

Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

Customer Property and Personal Items

The Customer is responsible for ensuring that no personal items, documents, valuables or other property that they wish to keep are left within or among the Waste presented for collection. Once an item has been removed as Waste, the Company is not obliged to recover, return or compensate for it.

Compliance with Waste Regulations

The Company operates under applicable UK waste management legislation and guidance. Waste is carried only by vehicles and carriers appropriately authorised or licensed where required. The Company will deliver collected Waste only to facilities that are licensed or permitted to receive such material.

For commercial or business Customers, the Company may issue a waste transfer note or equivalent documentation where required by law. The Customer must provide accurate information about the nature of the Waste to enable correct classification and handling. The Customer shall be responsible for any costs, fines or liabilities arising from incorrect or misleading information provided about the Waste.

Insurance

The Company maintains insurance cover appropriate to its operations, including public liability insurance at levels considered reasonable for a rubbish removal and waste collection service provider. Evidence of insurance may be provided to Customers upon request.

Complaints

If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue. The Company will investigate and, where appropriate, attempt to resolve the matter by re-attending the Site, offering a partial refund or providing another suitable remedy, at its discretion and subject to the circumstances.

Intellectual Property

All content, branding and materials used by the Company in relation to its rubbish removal and waste collection services, including any literature or promotional materials, remain the property of the Company or its licensors. They may not be copied, reproduced or used without prior written consent.

Privacy and Data Protection

The Company may collect and process personal data about Customers in order to accept bookings, provide Services, issue invoices and handle enquiries or complaints. Any personal data will be handled in accordance with applicable data protection laws and used only for legitimate business purposes connected with the provision of rubbish removal and waste collection services.

Amendments to These Terms

The Company may update or amend these Terms and Conditions from time to time. The latest version will apply to all new bookings made after the date on which the revised Terms and Conditions take effect. It is the Customer’s responsibility to review the applicable terms at the time of booking.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or the Services provided by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation provided by the Company, constitute the entire agreement between the Customer and the Company in relation to the Services and supersede any prior discussions, correspondence or understandings relating to the subject matter.
